By requesting or engaging Ruach Delivery (“Ruach”, “we”, “our”, or “us”) to handle and deliver your package, you acknowledge and agree to be bound by these Terms and Conditions.
These terms apply to all delivery requests made through our website, booking forms, WhatsApp, email, or any authorized communication channel. Ruach Delivery reserves the right to amend these terms at any time, and continued use of our services constitutes acceptance of the most current version.
Ruach Delivery provides same-day, express, and scheduled courier services within designated city areas, including Winnipeg and Edmonton. Inter-city or inter-province deliveries may be accommodated only upon special request, subject to availability, approval, and custom rates. Ruach Delivery does not operate as a national freight carrier.
All delivery requests are reviewed and confirmed by Ruach Delivery. An invoice with a secure payment link will be sent to the customer’s email. All payments must be made upfront and in full prior to dispatch. Submission of a delivery request does not constitute acceptance until payment has been received and confirmed.
Additional fees such as re-delivery, return-to-sender, or waiting-time charges may apply.
Delivery windows commence only after successful pickup. All delivery timeframes are estimates and may be affected by traffic conditions, weather, emergencies, or other factors beyond Ruach Delivery’s reasonable control. Ruach Delivery shall not be liable for delays resulting from such circumstances.
Senders are responsible for proper packaging, labeling, and accuracy of shipment information. Fragile or perishable items must be disclosed prior to pickup. Hazardous, leaking, improperly packaged, or unsafe items may be refused.
Ruach Delivery is not liable for loss or damage caused by poor packaging, mislabeling, inherent defects, or undisclosed fragile or perishable contents.
Ruach Delivery shall not be liable for damage, loss, or deterioration of restricted items, regardless of cause.
Ruach Delivery shall exercise reasonable care in handling accepted shipments. However, all services are subject to a strict limitation of liability.
In all circumstances where liability is established, Ruach Delivery’s maximum liability shall not exceed one hundred Canadian dollars (CAD $100) per shipment.
Under no circumstances shall Ruach Delivery’s liability exceed the amount paid for the delivery service. Ruach Delivery shall not be liable for indirect, incidental, consequential, or special damages, including loss of profit or business interruption.
Ruach Delivery does not offer declared value coverage, cargo insurance, or shipment insurance of any kind. Valuable, fragile, restricted, or perishable items are transported strictly at the sender’s own risk.
Acceptance of a shipment does not constitute an agreement to insure, guarantee, or declare the value of its contents.
If delivery cannot be completed after a five (5) minute wait and reasonable attempts to contact the sender and recipient, the shipment may be marked as a failed delivery.
Re-delivery or return-to-sender fees must be paid upfront. Ruach Delivery may retain undeliverable packages for up to seven (7) days. After this period, packages may be returned, redirected, or disposed of without liability.
Claims must be submitted in writing within forty-eight (48) hours of the scheduled delivery time. Approved claims, if any, are subject to the maximum liability limit of CAD $100 per shipment.
The sender agrees to indemnify and hold Ruach Delivery harmless from all claims, damages, losses, legal fees, or consequences arising from prohibited items, misdeclared contents, improper packaging, or breach of these terms.
Ruach Delivery reserves the right to refuse, cancel, or discontinue service due to safety concerns, prohibited items, non-payment, abusive behavior, fraudulent activity, or suspicious circumstances.
These terms are governed by the laws of the province where the shipment originates and the applicable laws of Canada. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
Ruach Delivery is committed to protecting the privacy of personal information collected in the course of providing delivery services. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA), Alberta’s Personal Information Protection Act (PIPA), and applicable privacy laws.
We collect personal information such as names, phone numbers, email addresses, pickup and delivery addresses, package descriptions, communications, payment confirmations (processed securely via Stripe), tracking data, and proof-of-delivery photographs.
Personal information is used strictly for service delivery, payment processing, customer communication, claims handling, fraud prevention, and service improvement. We do not sell personal information.
Proof-of-delivery and package photographs are retained for up to twenty-one (21) days, unless required for an active investigation or legal obligation.
Customers may request access to or correction of their personal information by contacting: contact@ruachdelivery.ca.
Use of Ruach Delivery’s services constitutes acceptance of these Terms & Conditions and Privacy Policy.
